These privacy policy, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our (mobile) website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or by negotiating and/or completing a sale/purchase contract, you acknowledge and agree to have read, understood and agreed to the privacy policy set out below (including the privacy statement).
These pages, the content and infrastructure of these pages, and the online service provided on these pages and through the website are owned, operated and provided by ME and are provided for your personal, commercial use only, subject to the privacy policy set out below.

1. Definitions

"Showroom", "us", "we" or "our" means Showroom Trading company,a limited liability company incorporated under the laws of Kuwait, and having its registered address at Shuwaikh Industry, Kuwait,
"Platform": means the Website,
"Service": means the procedures and process forarranging the Drive Test Appointment between the Car Dealer and Visitor,  enabling them to enter into purchase contract and/or the facilitation of paymentsof the Products,
"Car Dealer": means the provider or supplier of the Products or related product or service as from time to time available for the Services on the Platform,
“Client”: means the Visitor who concludes a sale/purchase contract with the Car Dealer,
“Parties”: mean the Car Dealer, the Visitor and/or the Client,
“Visitor”: means any person visitingand browsing the Website,
“Drive Test Appointment”: means car drive test service provided by the Car Dealer to the Visitor for testing the Products before its purchase by the Visitor,
“Products: mean cars and automobiles displayed by the Car Dealer on the Website, and
“Website”: means the (PC/mobile) website and application, owned by Showroom, on which the Service is made available.

2. Scope of our Service

• Through the Platform, we or provide an online platform through which you the Visitor can view the Products, negotiate a purchase contract with the Car Dealer, arrange and agree the Test Drive Appointment and conclude a binding sale/purchase contracts with the Car Dealer for the Products. Both the Car Dealer and Visitor enter into a direct and legally binding contractual relationship for the sale/purchase of the Products.It should be noted that,act solely as a broker between the Car Dealer and the Visitor/Client.

When rendering  he Service, the information that we disclose is based on the information provided to us by both the Dealer. As such, the Car Dealer and/ Visitor are fully responsible for updating their information and the Car Dealer, is therefore, responsible for updating all information regarding the Products particularly those relating to  prices , availability, models and other information which is displayed on our Platform. Although Showroom will use reasonable skill and care in performing the Service, Showroom will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform or otherwise, inaccurate, misleading or untrue information or non-delivery of information. Each Party remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our Platform. The Platform does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any Car Dealer (or its facilities, venue, products or services) made available.
The Visitor/Client should understand that the Service is made available for his/her personal and non-commercial use only. Therefore, the Visitors/Clients are not allowed to re-sell, deep-link, use, copy, monitor, display, download or reproduce any content or information, software, reservations, the Products or the Services for any commercial or competitive activity or purpose.
 

3. Payment for Services

3.1.By the Visitor: No fees are charged, unless Drive Test Appointment is agreed between the Car Dealer and Visitor. In this case only the Visitor shall paycertain amountbased on car typeper each Test Drive Appointment even if the same test drive repeated on the same car by the same Visitor.
3.2. Bythe Client: No fees are charged.
3.3. Payment Process:
3.3.1. Payment Method: payment by the Visitor shall be made using credit cards processed  through payment gateway provided by Showroom.
3.3.2. Payment Deduction Authorization: the Visitorherby authorize Showroom to charge and debit directly their banking accountswith the applicable fees and payment due to the Car Dealer and/or Showroom under this agreement.
 

4. Cease or Suspension of Services

It is agreed that Showroom may terminate or cease the Services at any time and for no cause without any liability.
 

5. Disclaimer

The Visitor and/or Client certify, warrant and agree that Showroom shall own the copyright to the photos/images and that you agree that ME may use the uploaded/downloaded photos/images on the Website, and in (online/offline) promotional materials and publications and as Showroom at its discretion sees fit. The Parties are hereby granting Showroom a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as Showroom at its discretion sees fit. By uploading/downloading these photos/images the person uploading the picture(s) the Parties accept full legal and moral responsibility of any and all legal claims that are made by any third parties.. Showroom disclaims all responsibility and liability for the pictures posted.. Any photo/image that does not meet the Showroom’s requirements will not be posted and/or can be removed/deleted by Showroom at any time and without prior notice.

7. Intellectual Property Rights

Unless stated otherwise, the software required for our services or available at or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by Showroom.
Showroom exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the Platform on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the Platform or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to Showroom. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).
 

7. Governing Law

This agreement shall be subject to Kuwaiti laws.

8. Dispute

Any dispute arising out from this Agreement shall be decided by Kuwaiti courts.
